3.3. The Buyer undertakes to check the condition of the parcel and to accept the goods delivered.

3.4. If the Buyer’s details given in the registration form change, the Buyer must update them without delay.

5.3. If the item is not in the Seller’s warehouse at the time of ordering, an order is created, which the Seller checks, and the Seller informs the Buyer of the delivery time by e-mail. The item is sent to the Buyer within the time needed to make and dispatch it. This time is stated in the message about the dispatch time of the order.

5.4. The contract enters into force from the moment the Seller, having received the order, confirms it by sending a confirmation e-mail to the address given by the Buyer.

5.5. Prices in the Online Shop are given in euros, including VAT. The minimum purchase is 10 euros including VAT.

5.7. The Buyer undertakes to pay for the goods within 48 hours of receiving the order confirmation by e-mail. The parcel is prepared, and the delivery time starts to run, only once payment for the goods has been received.

5.8. If the Buyer does not pay, the order is cancelled, but no sooner than after 48 hours.

6. Gift card rules

6.1. A gift card can be used to pay for goods and services at all of the Seller’s retail outlets listed at kameja.lt/kontaktai and in the Online Shop.

6.2. A gift card cannot be exchanged for money. Money paid for a gift card is not refunded, except where a Buyer who bought the gift card at a distance in the Online Shop withdraws from the contract within 14 (fourteen) days of the day the gift card was bought, in accordance with Article 6.228(10) of the Civil Code of the Republic of Lithuania.

6.3. Once a gift card has been used to buy goods and/or services, the money is not refunded under any circumstances, except where the holder of the gift card received faulty goods after using it. In that case the holder must contact the Seller without delay.

6.4. No change is given to the holder of a gift card who buys goods or services for less than the value stated on the gift card.

6.5. The value of a gift card cannot be split; it can be used only once.

6.6. If a gift card is not used within 3 months of the date stated in the “Date” field, it is considered invalid. Money paid for an unused gift card is not refunded.

7. Delivery of goods.

7.1. When placing an order, the Buyer undertakes to give the exact place of delivery and postcode and the correct phone number of the recipient of the parcel.

7.2. The Buyer undertakes to accept the goods personally; the parcel may also be accepted by a person present at the address given in the order. If the Buyer or other persons at the address given in the order cannot accept the goods, and the goods were delivered to the correct address, the Buyer has no right to make claims against the Seller for failure to meet delivery times.

7.3. Goods are delivered abroad by AB Lietuvos paštas, at the rates and within the times in force. Goods are sent only to the countries the Buyer is allowed to choose in the Online Shop.

7.4. In Lithuania goods are delivered by the parcel carriers the Seller works with. The place of delivery may be an address in Lithuania or a self-service parcel terminal of a carrier the Seller works with.

7.5. On delivery, the Buyer, the person named in the Buyer’s order or the person present at the address given in the order must check the condition of the parcel. If that person notices external damage to the parcel, this must be noted on the waybill and a free-form report of the damage must be drawn up. If the waybill is signed without remarks, the parcel is considered to have been handed over undamaged.

7.6. The Buyer agrees that, once the goods have been delivered to the address given in the Buyer’s order and the person who accepted them and/or the Buyer has signed the receipt or the VAT invoice, the goods are considered properly handed over to the Buyer and the Buyer has no claims in that respect.

7.7. If the Buyer refuses to accept the goods ordered, or delivery to the Buyer is impossible because the Buyer gave an incorrect delivery address when ordering, the Buyer must compensate the Seller for any loss incurred as a result.

7.8. The Seller is not liable for non-delivery or late delivery of goods ordered by the Buyer if this happened through the fault of third parties or because of circumstances which the Seller could not control and reasonably foresee when the contract of sale was concluded and whose occurrence or consequences the Seller could not prevent.

8. Returns and exchanges.

8.1. Exchanges and returns are governed by the Civil Code of the Republic of Lithuania.

8.2. The Seller guarantees the quality of the goods, so if you receive a faulty item you must contact the Seller without delay. A faulty item will be replaced with a sound one at the Seller’s expense: it is collected from the Buyer by a parcel carrier and a sound item is sent free of charge.

8.3. Withdrawing from a contract of sale concluded at a distance:

A Buyer who has bought goods of proper quality may withdraw from the distance contract within 14 days of the day the goods were delivered. In that case the Buyer must notify the Seller of the withdrawal by sending a properly completed model withdrawal form (available here: e-tar.lt/portal/lt/legalAct/dad7f330d05511e3a8ded1a0f5aff0a9 ) or a clear statement setting out the decision to withdraw from the contract, and must send or hand the goods back to the Seller without delay, and no later than 14 days after the day the withdrawal notice was given to the Seller, except where under the contract the Seller is obliged to collect the goods.

No later than 14 days after receiving the Buyer’s written withdrawal, the Seller refunds all sums paid by the Buyer, including the delivery costs paid by the Buyer. However, the Buyer bears the direct cost of returning the goods.

8.4. Returned goods of proper quality must be unused and undamaged, must have kept their consumer properties and must be in saleable condition, and the Buyer must have proof that the goods were bought from this Seller. The burden of proving that the requirements of the Civil Code on withdrawal were met lies with the Buyer.

8.5. The withdrawal procedure in clause 8.3 of these Terms does not apply to contracts for goods made to the Buyer’s special instructions, which are not made in advance and are produced according to the Buyer’s personal choice or instruction, or for goods that are clearly adapted to the Buyer’s personal needs, such as spoons engraved to order.

8.6. Returning goods bought in one of the Seller’s physical shops. If the Buyer does not like the shape, size, colour, model or completeness of the goods bought, then under point 18 of Order No. 217 of the Minister of Economy of the Republic of Lithuania of 29 June 2001 “On approval of the rules for the return and exchange of items”, articles of precious metal bought in the Seller’s physical shop may be returned or exchanged only with the Seller’s consent.

9. Intellectual property

9.1. All rights to the Shop and the works in it are protected. No content or information in the Shop may be reproduced, made publicly available or distributed without the Seller’s prior written consent.

9.2. All trade marks shown in the Shop are the property of the Seller or are lawfully used by the Seller.

10. Law

10.1. These Terms are drawn up in accordance with the laws and legislation of the Republic of Lithuania. This contract is governed by the law of the Republic of Lithuania.
